Terms of Service

Welcome to PropertyVR. These Terms of Service ("Terms") govern your use of the PropertyVR website at www.propertyvr.co and related services (together, the "Service"), operated by PropertyVR ("we", "us", "our"). By creating an account or using the Service you agree to these Terms. If you do not agree, please do not use the Service.

1. What PropertyVR is

PropertyVR is an online marketplace where real-estate agents, studios, and property owners ("Sellers") publish immersive 360° photo tours, video walkthroughs, and embedded virtual tours of properties, host live open houses, and take private-viewing bookings, and where visitors ("Buyers") can browse listings, join live events, and book viewings — including through Ailin, our AI booking concierge.

PropertyVR is a technology platform only. We are not a real-estate broker, agent, or advisor, we are not a party to any property transaction, and we do not verify ownership, pricing, or the accuracy of any listing. Always perform your own due diligence before making decisions about a property.

2. Your account

You must be at least 18 years old to create an account and publish listings.
Provide accurate information and keep your login credentials confidential. You are responsible for all activity under your account.
You may sign in with an email and password or with Google. Tell us immediately at the contact address below if you suspect unauthorized use of your account.

3. Listings and your content

You keep full ownership of the photos, videos, tours, text, and other material you upload ("Your Content").
By publishing, you grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, display, and distribute Your Content solely to operate and promote the Service, until you delete it or close your account.
You promise that you own or have permission to use everything you upload, that your listings are accurate and lawful, and that you have any consents required to show the property (including from people visible in the media).
We may remove content or suspend listings that violate these Terms or the law, or that we reasonably believe are fraudulent or misleading.

4. Acceptable use

You agree not to:

post false, misleading, infringing, or unlawful listings or content;
upload malware or attempt to probe, disrupt, or gain unauthorized access to the Service;
scrape or bulk-collect content or personal data from the Service;
impersonate another person or misrepresent your affiliation with a property;
use the Service to send spam or unsolicited marketing.

5. Plans, subscriptions, and billing

The Free (Starter) plan is limited — for example, up to 3 active tours, 2 live events per month, and 10 viewers per event.
Studio (USD 29/month) and Pro (USD 79/month) are paid subscriptions billed through our payment processor, Stripe; Pro adds features such as Ailin, the AI booking concierge, on your listings. Enterprise plans are agreed individually. We never see or store your full card details.
Subscriptions renew automatically until cancelled. You can cancel any time from the billing portal; cancellation takes effect at the end of the current billing period, and already-paid periods are non-refundable except where required by law.
If we change subscription prices, we will give you notice before the change applies to your next renewal.
If a payment fails or a subscription ends, your account returns to the free plan and its limits; your content is not deleted.

6. AI features and viewing bookings

The Service includes AI features: Ailin, a conversational booking concierge on tour pages (voice and text, powered by ElevenLabs), and an AI support assistant on the Help page (powered by Anthropic). AI-generated responses can be inaccurate or incomplete — they are provided for convenience and are not professional advice, and property facts should be confirmed with the Seller.
Voice conversations require microphone access, which your browser will ask you to grant; you can decline and type instead.
When you book a private viewing (through Ailin or otherwise), the appointment is between you and the Seller. We store the booking details, share them with the Seller, and send confirmation emails, but we are not responsible for either party attending, rescheduling, or cancelling. Sellers can cancel bookings from their dashboard and should inform the Buyer.

7. Third-party services

The Service integrates third-party services, each governed by its own terms: Supabase (authentication, database, and file hosting), Stripe (payments), Google (sign-in), Vercel (website hosting), ElevenLabs (conversational AI voice for Ailin), Anthropic (AI support assistant), Agora (live open-house streaming), Resend (transactional email), and embedded tour providers such as Matterport, Kuula, and CloudPano. Embedded tours are loaded from the provider's servers and remain the provider's and the Seller's responsibility.

8. Our intellectual property

The Service itself — including its design, software, and branding — belongs to us or our licensors. These Terms do not grant you any right to use it except as needed to use the Service normally.

9. Termination

You may close your account at any time. We may suspend or terminate accounts that breach these Terms, abuse the platform, or create legal risk, and we will tell you why unless the law prevents us. Sections that by their nature should survive (such as licences already granted, disclaimers, and limitation of liability) survive termination.

10. Disclaimers

The Service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement. We do not guarantee that listings are accurate, that the Service will be uninterrupted or error-free, or that any property will sell.

11. Limitation of liability

To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of the Service. Our total aggregate liability for all claims relating to the Service is limited to the greater of (a) the amount you paid us in the 12 months before the claim, or (b) USD 50.

12. Indemnity

You will defend and hold us harmless from claims arising out of Your Content, your listings, or your breach of these Terms.

13. Governing law

These Terms are governed by the laws of Thailand, and disputes will be resolved in the competent courts of Thailand, unless mandatory consumer law in your country of residence gives you additional protections.

14. Changes to these Terms

We may update these Terms from time to time. For material changes we will give reasonable notice (for example, by email or a notice on the site). Continuing to use the Service after a change takes effect means you accept the updated Terms.
